This Website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate bookings (whether through the Website or the associated call centre) or otherwise transacting business with travel suppliers, and for no other purpose (together the “Services”). The terms "we", "us", "our", "enjoyaus" and "enjoyaus.com" refer to enjoyaus.com, and Equity Consulting Services Pty Ltd affiliated companies. The term "you" refers to any person visiting the Website and using or seeking to use any of the Services. This Website and the associated Services are offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Terms of Use" or "Agreement"). Please read these Terms of Use carefully. By accessing or using this Website, booking any reservations for travel-related products or services displayed on the Website, or contacting our call centre (“Service Centre”) representatives, you agree that the Terms of Use then in force shall apply. If you do not agree to the Terms of Use, please do not use, or book any reservations through, this Website or our Service Centre representatives. We reserve the right at any time, at our sole discretion, to replace, change or otherwise modify the Agreement without prior notice by posting the revised version of this Agreement on the Website, and your continued access or use of this Website and the Services on and from the date it is posted to the Website signifies your acceptance of the replacement, updated or modified Agreement.

The information contained on this Website constitutes an invitation to treat and is not capable of acceptance by you. Any booking made or order placed by you shall be deemed to be an offer made by you to purchase the relevant travel-related products or services subject to this Agreement and any booking or carriage conditions of the relevant supplier. You acknowledge and agree that this Agreement constitutes a valid and enforceable contract that is formed outside of Australia only once payment has been processed electronically by us. We will process your payment at a location outside of Australia using secure methods.

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the "Platform") and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy statement).

These pages, the content, and infrastructure of these pages and the online reservation service (including the facilitation of payment service) provided by us on these pages and through the website are owned, operated, and provided by enjoyaus.com and are provided for your personal, non-commercial (B2C) use only, subject to the terms and conditions set out below. The relationship that we have with the Trip Providers are governed by separate terms and conditions which govern the (B2B) commercial relationship we have with each of these Trip Providers. Each Trip Provider acts in a professional manner vis-à-vis enjoyaus.com when making its product and/or service available on or through enjoyaus.com (both for its business-to-business ("B2B") and/or business-to-consumer ("B2C") relationship). Note that Trip Providers may have, declare applicable, and/or require (acceptance of) – in addition to the policies and fine print as disclosed on the website, their own (delivery/shipping/carriage/usage) terms and conditions and house rules for the use, access, and consummation of the Trip (which may include certain disclaimers and limitations of liability).

"enjoyaus.com," "us," "we," or "our" means enjoyaus.com, a limited liability company incorporated under the laws of Australia, and having its registered address at Suite 88, Jones Bay Wharf, 26-32 Pirrama Road, Pyrmont NSW 2009, Australia. "Platform" means the (mobile) website and app on which the Trip Service is made available owned, controlled, managed, maintained, and/or hosted by enjoyaus.com. "Trip" means the various different travel products and services that can be ordered, acquired, purchased, bought, paid, rented, provided, reserved, combined, or consummated by you from the Trip Provider.

"Trip Provider" means the professional provider of accommodations (e.g. hotel, motel, apartment, bed & breakfast), attractions (e.g. (theme) parks, museums, sightseeing tours), transportation provider (e.g. car rentals, cruises, rail, airport rides, bus tours, transfers), tour operators, travel insurances, and any other travel or related product or service as from time to time available for Trip Reservation on the Platform (whether B2B or B2C).

"Trip Service" means the online purchase, order, (facilitated) payment, or reservation service as offered or enabled by enjoyaus.com in respect to various products and services as from time to time made available by Trip Providers on the Platform.

"Trip Reservation" means the order, purchase, payment, booking, or reservation of a Trip.

Through the Platform, we provide an online platform through which Trip Providers—in their professional conduct of business (i.e. B2C or B2B)—can advertise, market, sell, promote, and/or offer (as applicable) their products and service for order, purchase, reservation, hire, and through which relevant visitors of the Platform can discover, search, compare, and make an order, reservation, purchase, or payment (i.e. the Trip Service). By using or utilizing the Trip Service (e.g. by making a Trip Reservation through the Trip Service), you enter into a direct (legally binding) contractual relationship with the Trip Provider with which you make a reservation or purchase a product or service (as applicable). From the point at which you make your Trip Reservation, we act solely as an intermediary between you and the Trip Provider, transmitting the relevant details of your Trip Reservation to the relevant Trip Provider(s) and sending you a confirmation email for and on behalf of the Trip Provider. enjoyaus.com does not (re)sell, rent out, offer any (travel) product or service.

When rendering our Trip Service, the information that we disclose is based on the information provided to us by Trip Providers. As such, the Trip Providers that market and promote their Trip on the Platform are given access to our systems and Extranet through which they are fully responsible for updating all rates/fees/prices, availability, policies and conditions, and other relevant information which is displayed on our Platform. Although we will use reasonable skill and care in performing our Trip Service, we will not verify if, and cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade, or maintenance of our Platform or otherwise), inaccurate, misleading, or untrue information or non-delivery of information. Each Trip Provider remains responsible at all times for the accuracy, completeness, and correctness of the (descriptive) information (including the rates/fees/prices, policies and conditions, and availability) displayed on our Platform. Our Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification, or (star) rating of any Trip Provider (or its facilities, venue, vehicles, (main or ancillary) products or services) made available.

Our Trip Service is made available for personal and non-commercial use only. Therefore, you are not allowed to resell, deep link, use, copy, monitor (e.g. spider, scrape), display, download, or reproduce any content or information, software, reservations, tickets, products, or services available on our Platform for any commercial or competitive activity or purpose.

As a condition of your use of this Website and any of the associated Services, you warrant that: (i) you are at least 18 years of age; (ii) you possess the legal authority to create a binding legal obligation; (iii) you will use this Website or any of the Services only in accordance with these Terms of Use; (iv) you will not use this Website for any purpose that is unlawful or prohibited by this Agreement; (v) you will only use the Website and the associate Services to make legitimate bookings for you or for another person for whom you are legally authorised to act; (vi) you will inform such other persons about the Terms of Use that apply to the bookings you make on their behalf, including all rules and restrictions applicable thereto; (vii) all information supplied by you on this Website or to a Service Centre representative is true, accurate, current and complete, and, in the case of information you provide about other individuals, you are authorised to provide such information; (vii) if you have a Website account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you.

Your use of this Website is intended for personal, non-commercial use and/or to make legitimate requests to book the Products offered. You agree not to use this Website to make any speculative, false or fraudulent requests.

Accordingly, as a condition of using this Website, you agree not to use this Website, its contents or information for any commercial or non-personal purpose (direct or indirect). While you may make limited copies of your travel itinerary (and related documents) for travel or service reservations booked through this Website, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Website. In addition, you agree not to:

1. use this Website or its contents for any commercial or unlawful purpose;

3. make any speculative, false, or fraudulent booking or any booking in anticipation of demand;

If your booking or account shows signs of fraud, abuse or suspicious activity, enjoyaus.com may cancel any travel or service reservations associated with your name, email address or account, and close any associated accounts. In addition, we may verify (i.e. preauthorize) your credit card. If you have conducted any fraudulent activity, enjoyaus.com reserves the right to take any necessary legal action and you may be liable for monetary losses to enjoyaus.com, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact enjoyaus.com Customer Service.

You need to create an account and provide information about yourself in order to use some of the features on the Website. You are responsible for maintaining the confidentiality of your account password and login credentials. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account.

Your account is for your personal, non-commercial use only. You may not impersonate someone else (e.g., adopt the identity of a celebrity), create an account for anyone other than yourself, provide an email address other than your own, or create multiple accounts. We reserve the right to close your account at any time for any or no reason.

We may terminate or suspend your account or ability to use the Website, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind. The information displayed on this Website concerning specific travel products and services is provided to us by the relevant travel suppliers (such as attractions or hotels) or their agents (“Third Party Suppliers”).This includes, but it not limited to, information about airfare and hotel prices, rules and availability and the description of hotels and their amenities. enjoyaus.com is not responsible for such information and we rely on the accuracy of the information supplied by the relevant Third Party Suppliers. If we become aware that the information provided by a Third Party Supplier is incorrect in any way, we reserve the right to correct any information (including, but not limited to, pricing information) and amend your booking (in consultation with you) to ensure that it reflects the correct price or otherwise complies with the correct information. Additional charges may be payable by you if you wish to proceed with the affected booking. Such charges will be advised to you at the time of consultation.

Additional terms and conditions imposed by the Third Party Suppliers may also apply to your booking and purchase of travel-related products and services, and we will advise you of these additional terms and conditions where the relevant Third Party Supplier provides them to us. Please read such additional terms and conditions carefully. You agree to abide by the terms and conditions imposed by any Third Party Supplier with whom you elect to deal, including, but not limited to, terms and conditions relating to the payment of all amounts when due, and compliance with the relevant Third Party Supplier's rules and restrictions regarding availability and use of products or services. We reserve the right to cancel your booking if full payment is not received in a timely fashion.

Some Third Party Suppliers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such Third Party Supplier's rules and restrictions may result in cancellation of your booking(s), in your being denied access to the applicable travel services and/or activities, in your forfeiting any monies paid for such booking(s), and/or in our debiting your account for any costs we incur as a result of such violation.

enjoyaus.com com does not operate or control the travel-related products and services displayed on the Website. Nor does enjoyaus.com com act as co-vendors with Third Party Suppliers with whom our customers book travel products or services.

As travellers shopping on our site, you have many options to help you find the perfect hotel, flight, car rental, cruise or activity. The “sort” settings allow you to order search results to your preference, whether based on price, verified review score, or other criteria. The “filter” settings also allow you to include or exclude various options to suit your travel needs.

The default setting of the ranking of Suppliers on our Platform is "enjoyaus.com Recommends" (or any similar wording); this is the Default Ranking. Note that the Default Ranking is created through a complex ever-changing and evolving system (algorithm) that considers a multitude of criteria in order to match searchers and accommodations in an optimal way. The actual ranking will be different for each customer and for each search as there are many criteria included, for example the popularity of an activity among our visitors (e.g. guest reviews), customer service history (including the number and type of guest complaints), certain booking-related data (e.g. number of bookings, cancellations, conversion rate, overbookings, availability, etc.) and the (past) browsing activities of a visitor. On-time payment of commission by Suppliers and the commission percentage are also included in the algorithm of the Default Ranking. Note that for convenience we also offer other ways to rank Suppliers. A customer can choose to rank, for example, on the basis of lowest price first, review scores, accommodation type (etc.). A customer thus has full control on the presentation of the search results.

If no options are selected, we will show a range of relevant options in the search results, based on the criteria outlined below:

• Lodging: Our default sort order reflects the relevance of properties to your search criteria, as we want to make sure you are able to quickly and easily find the offer that is right for you. We measure relevance by taking into account factors like a property’s location, its review scores, the popularity of the property (measured by how many travellers on our sites make bookings at that property), the quality of the content provided by the property, and the competitiveness of the property’s rates and availability, all relative to other properties meeting your chosen search criteria. The compensation which a property pays us is also a factor for the relative ranking of properties with similar offers, based on the relevance factors described above. On our non-default sorts (for example, if you sort by price or by star rating), we will order properties with similar results based on the factors above.
• Car Rental: Our default sort order is primarily driven by price, but we may consider other relevant factors such as popularity, customer reviews, convenience of pickup location, and car type or category.
• Cruise: Our default sort order is based on a number of relevant factors such as cruise line rating, ship rating, price per day, origin rating, destination rating, length of cruise, and booking window.
• Activities: Our default sort order is manually curated by our destination managers familiar with each market, taking into account such factors as price, popularity, distance from hotel options, and traveller feedback.
• Vacation Packages: When combining several different travel products into a vacation package, we use the criteria outlined above to determine the sort order for each product.

Additionally, we continually optimize our service to provide you with the best experience. Accordingly, we may test different default sort order algorithms from time to time.

In certain cities and regions, enjoyaus.com operates a preferred partnership program, allowing certain Trip Providers that meet and maintain the preferred program terms to be listed ahead of the rest of the Trip Providers in the default “Recommended” ranking for the relevant city/region. The preferred Trip Providers are marked with a “thumbs-up” symbol and in return for this high ranking, the preferred Trip Provider pays a higher commission. Only Trip Providers that meet and maintain certain qualification criteria can be listed as preferred.

All times displayed on our website are Australian local times, in 24 Hour format. For example, 3 o'clock in the afternoon will be shown as 15:00. Please note there is one hour difference between states within Australia during summer or the day light saving hours. The completed guest review may be (a) uploaded onto the relevant Trip Provider's information page on our Platform for the sole purpose of informing (future) customers of your opinion of the service (level) and quality of the Trip Provider, and (b) (wholly or partly) used and placed by enjoyaus.com at its sole discretion (e.g. for marketing, promotion, or improvement of our service) on our Platform or such social media platforms, newsletters, special promotions, apps, or other channels owned, hosted, used, or controlled by enjoyaus.com and our business partners. In order to offer and maintain recent (and therefore relevant) reviews, reviews can only be submitted within a limited period of time (28 days) after a visit and each review will only be available for a limited period of time (24 months) after posting. The default ranking of the reviews is by date of submission relative to a few additional criteria (such as language, reviews with comments), whereas a review of a customer who [always] submits comprehensive and detailed reviews (aka "Property Scout") may be ranked on top. enjoyaus.com will not accept reviews which include:

enjoyaus.com and the Trip Provider are each entitled to terminate their relationship for whatever reason (including in the event of breach of contract or (filing for) bankruptcy) with due observance of the relevant notice period as agreed between both parties.

You will receive a personalized enjoyaus.com voucher (“Voucher”) for each tour, event or service booked. In order to access and print your enjoyaus.com Voucher(s), you will be provided access to a secure webpage hosted by enjoyaus.com that contains a link to your enjoyaus.com Voucher(s).

You must provide the original, authentic enjoyaus.com Voucher to the appropriate service provider in order to redeem your tour, ticket, or package. Your reservation cannot be honored or redeemed without presenting a valid enjoyaus.com Voucher.

Please refer to your confirmation email with details of voucher redemption. In your confirmation email, you will be notified if you need to print out the voucher and present it upon arrival or if you can show it on your Devices, such as your smart phone or tablet. Please note, whether paper or electronic vouchers are accepted are subject to individual service provider. Failure to provide vouchers in requested format may result in refused to utilise the serviced booked. In such cases, you will forfeit full payment, no refunds available.

For security purposes, when redeeming your enjoyaus.com Voucher you must present a valid Photo ID and sign the enjoyaus.com Voucher. This is for identification purposes and helps us to prevent fraud.

In some cases enjoyaus.com also requires that you present the credit or debit card used to purchase your tour or ticket at the time of redemption. This generally applies only to attraction and show tickets. This helps us to prevent credit-card misuse. You will be advised at checkout whether or not you must present the credit or debit card used for booking. In some cases enjoyaus.com will waive this requirement, generally to facilitate gift purchases. However this requirement can only be waived by contacting our Customer Care team once your booking has been confirmed, and any changes or amendments will be made at our sole discretion.

If you make a purchase using a enjoyaus.com gift certificate (“Gift Certificate”), enjoyaus.com requires that you present the Gift Certificate used to purchase your tour, ticket or package at the time of redemption.

Please note that your enjoyaus.com Voucher(s) can be confiscated - and immediately cancelled without refund - if your signature and/or name do not match those shown on either your credit or debit card or Gift Certificate.

enjoyaus.com Gift Certificates may be obtained only at our website. All Gift Certificate sales are final. Gift Certificates are not refundable. enjoyaus.com is not responsible for stolen or lost Gift Certificates.

Accommodations

Some accommodation providers may require you to present a credit card or cash deposit upon check-in to cover any additional expenses that may be incurred during your stay. You are responsible for the payment of any additional expenses and any deposit taken or amounts charged to your credit card by the relevant accommodation provider are unrelated to any payment made through the Website for your hotel booking, including but not limited to phone bills, room services, meals, tips, mini bars you have consumed, dry cleaning or laundry services. The star rating and self rating displayed for hotel accommodations on the product pages of the Website are provided by the supplier. enjoyaus.com believes it is correct at time of supply but does not verify or guarantee its accuracy. It should be used as a guideline only.

The stars used for non-hotel accommodations (e.g. bed & breakfasts) do not correspond to the star ranking system as may be applicable to hotel accommodations.

The bedding configuration of each accommodation vary. Generally, Single Room means there is one bed in the room for one person to stay. Twin Room means there are two separate beds for two guests. Double Room usually has one double/queen bed for up to two guests. Triple Room means there will be a roll-away or sofa bed in addition to the standard twin room beddings to accommodate three guests. Only limited accommodations have rooms for four or more guests to stay, and usually utilize bunk beds or sofa beds. This information is a general guideline only. If you need information regarding precise bedding size or configuration, please contact the accommodation directly.

If you travel with children under 12 years old (age depends on individual accommodation supplier outlined on the product pages of the Website), they usually can stay with their travel companion free of charge using existing bed. Almost all hotels and accommodations are smoke free in Australia. There will be a penalty for smoking in room or within the hotel premises if it is a smoke free venue. It is your sole responsibility to check the rules regarding smoking for your travel, or stay.

Room Limit

You may not book reservations for more than 8 rooms online for the same hotel/stay dates. If we determine that you have booked reservations for more than 8 rooms in total in separate reservations, we may cancel your reservations, and charge you a cancellation fee, if applicable. If you paid a non-refundable deposit, your deposit will be forfeited. If you wish to book reservations for 9 or more rooms, you must contact enjoyaus.com group travel specialists by phone or by filling out the group travel form online. One of our group travel specialists will research your request and contact you to complete your reservation. You may be asked to sign a written contract and/or pay a non-refundable deposit.

Worry-free Shore Excursion

For products noted as a “Worry-free Shore Excursion”, if you are not returned to the ship in time to board, we will arrange the necessary transport to the next port-of-call. This policy applies only to our contracted local suppliers and only when, through no fault or action of your own, you are not returned to the ship in time to board. The policy is void in instances where delay is caused by your own actions and/or you have deviated from the enjoyaus.com activity or tour. You must supply enjoyaus.com with correct arrival and departure ship information and ensure there is enough time (minimum 2 hours) between the tour end time and the ship departure time. You must contact enjoyaus.com directly to request next port-of-call transportation arrangements as customers cannot book their own travel. enjoyaus.com will select and book travel for you to the next port of call (not to exceed US$1,000 per person). In addition, if your ship misses a port of call or is delayed beyond the commencement time of your Worry-free Shore Excursion, simply contact enjoyaus.com within 14 days. Pending verification of the ship's actual itinerary, we will issue you a refund. enjoyaus.com 'Worry-Free Shore Excursion' guarantee does not apply to excursions with private tour guides booked through enjoyaus.com Private Guide program.

Private Tour Guides

enjoyaus.com provides customers with information regarding private tour guides in many destinations. Private tour guides are independent contractors and not agents or affiliates of enjoyaus.com. enjoyaus.com does not screen or conduct background checks on private tour guides. Your use of private tour guides is at your sole risk.

Customers are responsible for working directly with private tour guides on scheduling, meeting time / place, tour specifics and, where specifically noted, payment terms. enjoyaus.com makes no representations or warranties of any kind regarding private tour guides or their services.

If Private Tour Guide fee is included in the package or services you booked and paid through our Website, only guiding service is covered by such fee you paid. Private Tour Guides will not provide bell service, check-in and check-out service to accommodations, or boarding assistance for airplanes, ferries, cruises, or buses, unless you have come to an agreement with the Private Tour Guide for such services at your own cost and risk, or have arranged such services with enjoyaus.com in advance in writing.

Please also read carefully on the product page on the Website for inclusions if your Private Tour Guide will escort you into attractions. Most packages only include admissions to attractions for travellers only. Private Tour Guide escort to such attraction is extra on your own cost.

If your Private Tour Guide is also a driver, by regulations, he/she is not allowed to leave the vehicle to escort you to visit any sites or attractions.

Pricing, Inclusions and Exclusions

The prices as offered by the Trip Providers on our Platform are highly competitive. All prices for your Trip are displayed including Australian local tax and all other taxes (subject to change of such taxes) and fees, unless stated differently on our Platform or the confirmation email/ticket. Prices listed on the Website are per person and in Australian dollars by default, unless otherwise specified. Applicable fees and taxes (including tourist/city tax) may be charged by the Trip Provider in the event of a no-show or cancellation.

Sometimes cheaper rates are available on our Platform for a specific product, or service, however, these rates made available by Trip Providers may carry special restrictions and conditions, for example non-cancelable and non-refundable. Check the relevant product, service, and reservation conditions and details thoroughly for any such conditions prior to making your reservation.

The crossed-out rate shown for travel related services is based on the Recommended Retail Price provided by individual service provider. To ensure we are making a fair comparison, we always use the same Trip conditions (e.g. cancellation policy, ancillary products (such as meal plan) and Trip type). This means that you get the same Trip for a lower price, compared to other check-in or consummation dates at the same time of year.

Obvious errors and mistakes (including misprints) are not binding.

All special offers and promotions are marked as such. If they are not labeled as such, you cannot derive any rights in the event of obvious errors or mistakes.

Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by enjoyaus.com.

Price quotations are subject to change without notice, until a booking has been confirmed.

Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.

Prices do not include tips/gratuities to tour directors, drivers or local guides; bell services; passport and visa fees; baggage and personal insurance; fees for extra luggage; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed under “Inclusions” on the product pages of the Website.

Where infant is travelling free of charge with an accompany adult, no meals or services are available to the complementary infant, unless otherwise stated by the relevant product or service on the product pages of the Website. For example, if the infant is travelling free of charge with the parent(s) on a cruise, the infant normally needs to seat on his/her parent lap.

Free of charge for services to our consumers

Unless indicated otherwise, our service is free of charge for consumers because, unlike many other parties, we will not charge you for our Trip Service or add any additional (reservation) fees to the rate. You will pay the Trip Provider the relevant amount as indicated in the Trip Reservation (plus—insofar not included in the price—relevant applicable taxes, levies, and fees (if applicable)).

Trip Providers pay a commission (being a small percentage of the product price (e.g. admission price)) to enjoyaus.com after the end user has consummated the service or product of the Trip Provider (e.g. after the guest has visited (and paid) the attraction). Trip Providers can improve their ranking by increasing their commission (Visibility Booster). The use of the Visibility Booster (by increasing the commission in return for a better position in the ranking) is at each Trip Provider's discretion and may be used from time to time and product to product offered. The algorithm of the ranking will take an increase in commission into account when determining the Default Ranking. Preferred partners pay a higher commission in return for a better position in the ranking.

Only Trip Providers which have a commercial relationship with enjoyaus.com (through an agreement) will be made available on Platform (for their B2B and/or B2C promotion of their product). enjoyaus.com is not an open platform (like Amazon or eBay) where end users can make their product available (no C2C platform); enjoyaus.com does not allow non-professional parties to offer or sell their products on or through enjoyaus.com.

Payment Processing

When you book a reservation for a Product through the Website, enjoyaus.com redirects you to a third party payment gateway who collects your payment information and processes your payment as described below under “Payment Processing”. We accepts Mastercard, Visa, American Express, and Discover credit card via PayPal, debit card via Polipya, and RMB via wechat Pay or Ali Pay. A small amount of surcharge or service fee for processing credit or debit card payments may apply and charged by the payment gateway you choose to use. enjoyaus.com has no control over the surcharge or service fee set out by the payment gateway. enjoyaus.com is not associated with these additional fees and will not be held liable for any fees relating to varying exchange rates and card issuer fees. Full payment by credit or debit card, or RMB is required to make a reservation. Payment will be listed as enjoyaus? Equity Consulting Services Pty Ptd? on your transaction statement.

Credit Card or Bank Transfer

If applicable and available, certain Trip Providers offer the opportunity for Trip Reservations to be paid (wholly or partly and as required under the payment policy of the Trip Provider) to the Trip Provider during the Trip Reservation process, by means of secure online payment (all to the extent offered and supported by your bank). For certain products and services, enjoyaus.com facilitates (through third party payment processors) the payment of the relevant product or service (i.e. the payment facilitation service) for and on behalf of the Trip Provider (enjoyaus.com never acts nor operates as the merchant of record). Payment is safely processed from your credit/debit card or bank account to the bank account of the accommodation provider through a third party payment processor. Any payment facilitated by us for and on behalf of, and transferred to the Trip Provider will in each case constitute a payment of (part of) the booking price by you of the relevant product or service in final settlement (liberating payment) of such (partial) due and payable price and you cannot reclaim such paid monies.

For certain (non-refundable) rates or special offers, note that Trip Providers may require that payment be made upfront by wire transfer (if available) or by credit card, and therefore your credit card may be pre-authorized or charged (sometimes without any option for refund) upon making the Trip Reservation. Check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your Trip Reservation. You will not hold enjoyaus.com liable or responsible for any (authorized, (allegedly) unauthorized or wrong) charge by the Trip Provider and not (re)claim any amount for any valid or authorized charge by the Trip Provider (including for pre-paid rates, no-show, and chargeable cancellation) of your credit card.

Many bank and credit/debit card companies charge their account holders a transaction fee when the card issuer and the "merchant location" (as defined by the card brand (e.g. Visa, MasterCard, American Express)) are in different countries. The currency exchange rate, if applicable, and any transaction fee are determined solely by the bank or other agency processing the transaction. These fees may be applied by the card issuer as a charge to the cardholders account. This means the amount listed on your credit or debit card statement may be a different figure than the figure shown on the billing summary page for a booking made on the Website. If you have any questions about these fees or any exchange rate applied to your booking, please contact your bank.

In the event of credit card fraud or unauthorized use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse, which may sometimes be subject to a deductible. In order to indemnify you, make sure that you report this fraud to your credit card provider (in accordance with its reporting rules and procedures) and contact us immediately by email (web@enjoyaus.com). State "credit card fraud" in the subject line of your email and provide us with evidence of the charged deductible (e.g. policy of the credit card company). This indemnification only applies to credit card reservations made using enjoyaus.com's secure server and the unauthorized use of your credit card resulted through our default or negligence and through no fault of your own while using the secure server.

Cancellations, No-shows and Refunds

By making a Trip Reservation with a Trip Provider, you accept and agree to the relevant cancellation and no-show policy of that Trip Provider, and to any additional (delivery) terms and conditions of the Trip Provider that may apply to your Trip (including the fine print of the Trip Provider made available on our Platform and the relevant house rules of the Trip Provider), including for services rendered and/or products offered by the Trip Provider. The relevant (delivery/purchase/use/carrier) terms and conditions of an Trip Provider can be obtained with the relevant Trip Provider. The general cancellation and no-show policy of each Trip Provider is made available on our Platform on the Trip Provider information pages, during the reservation procedure and in the confirmation email or ticket (if applicable). Note that certain rates, fees, or special offers are not eligible for cancellation, refund, or change. Applicable city/tourist tax may still be charged by the Trip Provider in the event of a no-show or charged cancellation. Check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your reservation. Cancellation and prepayment policies may vary per segment, product, or service of each Trip. Note that a Trip Reservation which requires down payment or (wholly or partly) prepayment may be cancelled (without a prior notice of default or warning) insofar the relevant (remaining) amount(s) cannot be collected in full on the relevant due or payment date in accordance with the relevant payment policy of the Trip Provider and the reservation. Cancellation and prepayment policies may vary per segment, product, or service of each Trip. If you want to review, adjust, or cancel your Trip Reservation, revert to the confirmation email and follow the instructions therein. Note that you may be charged for your cancellation in accordance with the Trip Provider's cancellation, (pre)payment and no-show policy, or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the accommodation provider carefully prior to making your reservation, and remember to make further payments on time as may be required for the relevant reservation.

If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this with the Trip Provider so they know when to expect you to avoid cancellation of your Trip (Reservation) or charge of the no-show fee. Our customer service department can help you if needed with informing the Trip Provider. enjoyaus.com does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Trip Provider.

No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals or any other services utilized.

Cancelling a booking with enjoyaus.com can result in cancellation fees being applied by enjoyaus.com, as outlined below. Additional fees may be levied by the individual supplier or tour operator (see your enjoyaus.com Voucher for specific details). When cancelling any booking you will be notified via email of the total cancellation fees.

• Event, Attraction, Theater, Show or Coupon Ticket These are non-refundable in all circumstances.
• Gift Certificate These are non-refundable in all circumstances.
• Other Tour Products & Services

• If you cancel before the LAST CANCELLATION DATE of the relevant tour products and services of the scheduled departure, there is no cancellation fee.
• If you cancel on or after the LAST CANCELLATION DATE of the relevant tour products and services of the scheduled departure, there is a 100 percent cancellation fee.

• enjoyaus.com does not charge a fee to amend or change the dates of an existing booking, as long as the request is received by our Customer Care team before the LAST CANCELLATION DATE stated on your confirmation email. However, it may be subject to a fee charged by the relevant Trip Provider.
• It is not possible to change or modify a special event, theater or show ticket. Sales of these tickets are final and cannot be amended once your original purchase is confirmed.
• All other date-change requests and amendments are subject to availability by our suppliers and/or service providers; enjoyaus.com cannot guarantee the success of any date-change request.
• If you request a date change after the LAST CANCELLATION DATE stated on your confirmation email, enjoyaus.com will attempt to honor your request; however changes made after the LAST CANCELLATION DATE may be subject to an additional fee. For multi-day and overnight tours, date changes made after the LAST CANCELLATION DATE may also be subject to additional fees.
• If you request to reduce the number of travellers booked, it is treated as cancellation. Please refer to the section “Cancellations, No-shows and Refunds” above for full information.
• If you make a purchase using a enjoyaus.com promotion code, or if you accept a discount or special-offer price during the enjoyaus.com checkout process, you may invalidate your discount or special-offer price by making any changes or amendments to your itinerary once your purchase is complete. enjoyaus.com may decide, at its sole discretion, to honor your discount or special-offer pricing if you make a post-purchase change or amendment to your itinerary. However enjoyaus.com reserves the right to invalidate your discount or special-offer pricing if you make any changes to your confirmed itinerary.

Occasionally our suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, and other Product features and/or requirements. As a result, enjoyaus.com reserves the right to cancel, change or substitute any service, tour, ticket or product that you have booked at this Website, at any time, for any reason.
